New Delhi, 27 Jan 2020 [Fik/News Sources]: No individual from one faith should be permitted to question beliefs of others, All India Muslim Personal Law Board submitted in a petition to the Supreme Court, News 18 reported.
The Ulema (religious scholars) of the Board said that Article 44 in the constitution regarding the Uniform Civil Code which talks about having a common law for the entire country, was “only a directive principle of state policy and is not enforceable”.
The Board emphasized that the ‘Mohammedan Law is based on the Holy Quran and Hadith.’ Its validity can’t be tested on a challenge.
The Board moved the court against the PIL that challenges the validity of polygamy in Islam and nikah halala among Muslims.
BJP member Ashwini Upadhyay who filed the PIL claiming such practices violate Muslim women’s right to live with dignity and privacy.
Responding to this attempt to bring about a change in the Mohammedan law, the Muslim Personal Law Board has claimed these practices may not fall under the purview of the “law in force” and are hence beyond the purview of judicial review.
The board has urged to be permitted to argue when Upadhyay’s petition comes up for a detailed hearing.
