94C, 94CC: More applications rejected than accepted!

Mangaluru, 15 July 2019 [Fik/News Sources]: Of the applications submitted in DK and Udupi districts under the 94C and 94 CC category for owning houses which were illegally build on government land, the rejection rate of the application is much higher than the approval rate!

Altogether, 1,07,245 applications have been submitted in DK district under Sakram (Sec 94 C rural) for regularization of the illegally constructed houses and interestingly, 45,884 applications have been approved while 51,209 applications have been rejected for various reasons. In Udupi the situation is worse with 33,749 applications being submitted of which a mere 6,965 have been approved and the remaining 22,798 applications have been rejected.

Under the 94 CC rule for urban areas, 40,245 applications were submitted of which 23,702 have been approved and 11,823 have been rejected. Similarly in Udupi, of the 8,948 applications submitted, 1,942 have been approved while 5,930 faced rejection.

Reasons behind rejection

When 94C rule was implemented in the rural areas, people from the cities had applied for it. Later, when 94CC rule was introduced, they once again submitted applications. Thus the total number of submitted applications rose drastically. These applications have been reviewed and ineligible applications have been rejected. Besides, 94C and 94CC were amended in 2012,14 and 15 which gave rise to instances where in members of the same family have applied multiple times and in some cases, a single person has applied multiple times. Due to these multiple applications, the total number of applications has increased. In some cases, the applications have been approved, but since the applicant has not yet received the completion certificate, they have submitted a fresh application presuming it to be necessary.

Applications from those who already own a house!

Amidst this, there are several cases wherein, people who already own a house have also applied under 94C and 94 CC. Some others also have applied even though live on the land belonging to the Forest Department. The applications submitted by those residing on private land and Kumki land have been rejected.

There was opportunity to submit applications under 04C and 94CC until the announcing of the Lok Sabha elections. But presently it has been stopped. Meanwhile the Revenue minister has directed all PDOs and tahsildars to dispose all the submitted applications within 3 months.

More in Belthangady, Karkala

13,269 applications have been rejected under 94C in Belthangady taluk and this is the highest amount in DK district. Next in line is Bantwal (10,699). Surprisingly, all the 1,194 applications submitted in Mulki taluk have been rejected. 5,680 applications under 94CC have been rejected in Mangaluru, which is the highest in the district. This is followed by Moodbidri (2,183). Karkala leads in the number of 94C applications rejected in Udupi district at 7,172 while Kundapur is at 5,607. Karkala also has the highest number of applications rejected under 94CC category at 2,632 followed by Udupi at 1,957.

What is 94C, 94CC?

This is the scheme to provide completion certificates to those residing in the houses which were built on government land in rural areas before 2012. Applications for the same are submitted under Karnataka Land Revenue Act 1964 Sec 94C. For those living in houses built on government land in urban areas submit their applications for regularization under Karnataka Land Revenue Act 1964 Sec 94CC.

Ineligible applications rejected

It is impossible to provide completion certificate under 94C and 94CC rule if a member of the family has a house or a site, if they are eligible to pay income tax, those who do not have an illegal building on government land if the land is Kumki land or within the limits of CRZ.
